Summary

The offense of non-alimony combines many features which, even individually, cause a number of interpretation difficulties. It is first and foremost an offence commited by omission, permanent and complex. The need to reflect on the shape of the crime under art. 209 §1 of the Penal Code lies primarily in the fact that in 2017 the Penal Code was amended, what significantly altered the discussed offence, necessitating a revision of many views contained in the jurisprudence of the Supreme Court, courts of general jurisdiction and in the votes of representatives of the doctrine. This text is devoted mostly to the analysis of the nature of persistence and complexity of the offense of non-alimony, determining the time of its perpetration and termination, and the relationship that exists between it and the principle of res judicata.
